Abstract
L’articolo esamina la teoria degli organi della pubblica amministrazione come criterio di imputazione della responsabilità. In particolare, attraverso lo studio della responsabilità in materia di servizi pubblici e nell’ambito dell’esercizio del potere, si cerca di verificare l’attualità della teoria organica alla luce dell’art. 28 della Costituzione.
This paper examines the theory of bodies of the public administration and the principle of responsability. In particular, through the analysis of responsability for public services and liability within the exercise of administrative powers, the study focuses on the actuality of this theory and the application of art. 28 of the italian Constitution.
