Abstract

The essay looks at the forms of shared administration present the Codice del Terzo settore (co-programmazione and co-progettazione) to see if in what ways these legal institutes innovate with respect to the classic patterns of administrative decision-making mechanisms, proposing an overcoming of the traditional patterns, which are basilarly marked by unilateralism, especially in planning.

The constitutional foundation is sought in the principle of horizontal subsidiarity, analyzing what implications such a constitutional matrix determines in the operational dynamics of co-programmazione and co-progettazione, in terms of investigative, procedural and decisional guarantees.
