Abstract
The paper deals with the foundations of public administration liability for conduct contrary to fairness, a liability that may arise without any illegitimate act being taken. The attention is then turned to the requirements of this type of liability and on the related legal regime. In the last part, the article argues the non-contractual nature of the administrative liability and focuses on the structure of the division of jurisdiction.
