Abstract
The essay aims to identify the key themes of a broader investigation into the function of regulation, highlighting the reasons for the inquiry and its overall purpose. The approach adopted seeks to overcome the dichotomy between public and private law, aiming to reconstruct a different general theory of regulation from a unified perspective.
This shift places individuals' rights at the center and views regulation as a tool to enable the enjoyment of those rights, which would otherwise remain unrealized.
