Abstract
The contribution takes its starting point from Maria Cristina Cavallaro's essay, Migrant management, health emergency and public safety: towards an 'administrative law of the enemy'? and comes to observe that the mix of criminal law - administrative law, criminal trial and administrative procedure, has always characterised the Italian legal system: the objective of security has always been pursued with both kinds of measures, emphasising how the preventive measure entails obligations and limitations for the defendant.
