Abstract
L’articolo mira ad analizzare le relazioni tra stato e mercato nel diritto amministrativo. In particolare, si intende sostenere come interessi legali di uguale o maggiore valore rispetto ad interessi economici nel sistema di produzione globale sono fondati sulla legislazione nazionale, europea e internazionale. In questa prospettiva, l’ecologia rappresenta un caso paradigmatico. Da questo punto di vista, si guarderà al rapporto tra economia ed ecologia a partire dalla derivazione comune (l’oikos) che lega i due termini ed attraverso l’opera di intermediazione del diritto (il nomos).
The article aims to analyse the relationship between state and market in the administrative law. I emphasise that the legal interests of equal or greater value than economic interests in the system of the global production are grounded on International, European and Italian legislation. Ecology matters as a paradigmatic case. From this point of view, I intend to stress the relationship between economics and ecology by discussing the common derivation (i.e. oikos) that links the two terms through the intermediation of law (i.e. nomos).
