Abstract
The evolution of the Mafia phenomenon has made it necessary to provide suitable instruments to stem it and cut off all contact with public institutions.
The paper analyzes the measures of the dissolution of the municipal councils for the mafia and the interdictive anti-mafia information, respectively, necessary to combat the infiltration of the mafia in the public administration and in the legal economy.
It is necessary to consider whether these instruments based on wide discretion are not extremely restrictive of the interest of the private sector and how this can be balanced with the overriding public interest.
