Widespread interests and legitimacy to act through the filter of unjust damage

Abstract

Widespread interests are fluid entities, which have experienced different protections over time: objective and subjective; public and private; collective and individual. This contribution focuses on individual protections, based on the individual's legitimacy to act, who, while activating a subjective legal situation, guarantees the realization of those values ​​which are normally identified as widespread interests. In particular, the research proposes a reading that connects the conditions of action with the civil liability system, envisaging the legitimation of all those who suffer unjust damage.
