Administrative impartiality as a right.: Some remarks on the “complex relationship” between citizens and public administration

Abstract

The paper examines the object and nature of an individual right to administrative impartiality, on the basis of the approach and arguments analytically outlined in L’imparzialità amministrativa come diritto. Epifanie dell’interesse legittimo (Maggioli, 2021). A subjective reinterpretation of impartiality, suggested by the developments in the Italian legal system and the European context, may have useful practical implications. The effort to identify an individual right to impartiality also makes it possible to reflect on the nature of citizens’ rights in their relationship with the public administration.
