Abstract
The contribution examines the relationship between Constitution and bargaining power, in the light of recent constitutional judgments on the subject of “unfair” or unbalanced contracts. The analysis focuses, therefore, on the application to the contract of the constitutional principles of equality and social solidarity, highlighting the related criticalities.
