Abstract
La legittimazione speciale delle autorità indipendenti è tema assai discusso ed alimenta oggi il dibattito in essere sulla più o meno vacillante natura soggettiva della giurisdizione amministrativa. Lo studio si concentra sui profili più controversi della disciplina positiva dei presupposti e delle condizioni previste affinché le autorità possano assumere il ruolo di parte ricorrente. Oggetto di indagine è, in particolare, la legittimazione attiva dell’Autorità nazionale anticorruzione, cui si accompagnano criticità sia dal punto di vista procedimentale che processuale.
The paper analyses the standing to sue of independent authorities as a special prevision in the administrative process, underlining the compatibility with the principles of judicial review. The research is focused on the main critical issues of the regulation of Anac’s standing, where are not clearly defined the rules applicable to these new procedures.
