Obiettivi, strumenti e metodi dell’intelligenza artificiale nella tutela della salute e della sicurezza dei lavoratori

Abstract

PStarting from the assumption that digital transformation is capable of bringing about consequences never before experienced on the social, economic and labor system, the EU legislator, making use of a regulatory style track already envisaged by the Gdpr, issued EU Reg. 2024/1689, better known as the Artificial Intelligence Act, with the aim of regulating the use and development of artificial intelligence-based systems in member states. The following work is divided into two parts. The first aims to highlight how digital transformation could favorably affect the prevention of occupational injuries and illnesses where it was employed by companies with awareness and empowerment and with respect for the privacy and dignity of the worker. The second part focuses on the adequacy of such recent regulation UE to exhaust much-needed normativity in the context of AI-induced (or assisted) transformation on health and safety protection. The common denominator of the two sections is found in the verification of compatibility with the current framework of domestic regulation and the value baggage of constitutional principles.
