Abstract
The review examines the main theses on legal interpretation set out in the first part of Fabio Saitta's book. In particular, three issues are dealt with: a) the conditions of the expansion of judicial discretion in the current historical legal context; b) the analysis of the ‘methodological’ problems of legal interpretation; c) the intertwining of the issues mentioned in the two previous points.
