Abstract

Among the news included in the new Directive on credit agreements for consumers, debt advice is particularly interesting. CCD II intends to build a regulatory system able to increase protection for subjects receiving funds offering new instruments guaranteeing a correct and efficient use of consumer credit instruments, avoiding lenders’ irresponsible behaviour, limiting over-indebtedness. The new rules are set to redesign the regulatory framework according to new criteria, also for our legal system.

Debt advice represents a real novelty, both for the role it is given and for the needs it will meet.

It is a particular kind of advice that is characterised by some distinctive features: anticipatory protection against potential situations of crisis, the heterogeneity of the activities through which it is offered, advisors’ independence, their professionalism.

The new model should meet on the one hand consumers’ needs and on the other creditors and the system’s needs, joining at the same time private and public interests.

It will be necessary to design a regulatory framework able to put into practice the meritorious principles outlined by European legislators.
