Abstract

The contribution investigates how shared administration tools can help overcome the critical issues that still persist in the management and allocation of property confiscated from organized crime with a view to its social reuse.

Given that the regulatory framework does not expressly provide for the involvement of local communities in decision-making processes, due to the absence of specific provisions to this effect in Legislative Decree No. 159 of 6 September 2011 (the so-called Anti-Mafia Code), the paper reflects on how certain institutions, such as co-planning and co-design, regulated by Legislative Decree No. 117 of 3 July 2017 (the so-called Third Sector Code), and collaboration agreements for the care and regeneration of urban common goods, provided for by numerous municipal regulations and some regional laws, can be incorporated into the procedure from seizure to final allocation of assets confiscated from organized crime.

The aim is to outline a model of administration based on the involvement of citizens, whether individuals or associations, and on civic co-responsibility in the administration and enhancement of these assets, capable of making the social function of confiscation effective and strengthening the trust of local communities in institutions.
