Project finance: peculiarities in light of the new public procurement code

Abstract

This paper expresses some reflections on the discipline of the project finance institute, retracing its evolutions following the succession in a short time of regulatory and corrective texts that have determined a comprehensive revision. Project finance represents an increasingly widespread financing method in the sector of public works and services, of interest to those public bodies forced to face a progressive reduction in the availability of resources to carry out public interventions often of high technical complexity. Despite simplification interventions, the recent reform seems not to have overcome the flaws of the previous discipline through a series of disincentives for private investors. Critical issues therefore remain on the effective attractiveness of the institute towards potential promoters.
