Digitalization, administration and human being: towards a “reserve of humanity” among codicistic insights of a legal theory of automation

Abstract

The paper questions the role to be accorded to the human person in automated administrative procedures and the existence of a “reserve of humanity” in the execution of administrative functions, pointing out how the most recent legislative interventions in the field of public procurement (the new Codice dei contratti pubblici – d.lgs. n. 36 del 2023) now depose in this direction.
