The evolution of good faith principle in the digital transformation of public contracts

Abstract

The article focuses on digital transformation and innovation in public contracts following the introduction in the Italian Law of the principles of collaboration and good faith among public administration and individuals (mainly economic operators, in public contracts). These principles are imposed on the public administration and on the economic operators during the “multiple” or “parallel” negotiations aimed at selecting the contractor. The digitalisation by default and the implementation of the once only principle require a renewed “digital alliance” between professionally adequate administrations and qualified economic operators, ensuring full traceability, effective transparency, and promptness for the ultimate goal of the correct execution of public contracts.
