Abstract
The paper analyzes the salient contents of Legislative Decree No. 208 of 2021, which implemented Directive 2018/1808/EU. The new Testo Unico dei servizi di media audiovisivi (Tusma) contains the new regulation of radio and television, including not only linear and catalog services but also video-sharing platforms (video-sharing). Regarding the protection of pluralism, the system of fixed thresholds is overcome for a regime based on the duty to notify to be followed by the Authority's investigation to verify pluralism in the sector. Protection of minors in front of screens is strengthened by new rules. Commercial communications are made even more flexible because of the increased offer and user choice. The single text strengthens the regulatory powers of the Independent Administrative Authority.
