Procedimenti e decisioni amministrative in materia di attività economiche

Abstract

I procedimenti amministrativi che si concludono con decisioni in materia di attività economiche sono di diversi tipi. Il primo tipo è costituito da provvedimenti di regolamentazione generale o di programmazione, infrastrutturale, economica o territoriale. Le procedure di formazione prevedono la partecipazione delle comunità o degli operatori interessati. Il secondo tipo è costituito da procedure e decisioni su casi singoli, anche tecnicamente complessi (ad esempio riguardanti la tutela dell’ambiente). Molto spesso le leggi si limitano ad indicare obiettivi e quindi le amministrazioni hanno ampi poteri di scelta su come raggiungerli. Le decisioni “economiche” devono essere tempestive, proporzionali, tecnicamente fondate, discusse con gli interessati, prevedere gli effetti dell’attività economica, rispettose della concorrenza.

There are several administrative procedures that conclude in decisions on economic activities. The first type are the regulatory measures (general or infrastructural, economic and local planning). The procedures provide for the participation of the communities or of the interested operators. The second type are the procedures and decisions on individual cases, also technically complicated (for example about the protection of the environment). Very often laws only specify the objectives and, therefore, the administrations have wide powers of choice on how to reach them. “Economic” decisions must be timely, proportional, technically grounded, discussed with the interested parties, in compliance with the competition, and they must foresee the effects of the economic activities.
