L’esposizione a sostanze tossiche, emblema della transizione ecologica: dai limiti costituzionali a quelli tecnico-operativi

Abstract

The essay – starting from the emblematic relief of exposure to toxic substances – investigates the most topical issues on the level of principles, rules and case law concerning the protection of workers’ health and environmental salubrity in the delicate phase of ecological transition. The analysis focuses, in particular, on the constitutional amendment of Articles 9 and 41 of the Constitution in the light of the recent constitutional judgment no. 105/2024, but also on the innovations promoted by supranational law, in terms of regulatory and jurisprudential form. The reflection, without omitting the systematic vision, highlights progress and critical aspects of the current prospect of protection – hopefully integrated – of social and environmental datum.
