Alcuni profili interpretativi del CCNL Multiservizi in relazione al cambio di appalto

Abstract

[Some interpretative profiles of the “Multiservices” collective labor agreement, with specific regard to the succession in the supply contract] Several collective labor agreements contain “social clauses”, intended to safeguard the employment of workers engaged in the performance of services entrusted by the client companies to the suppliers, in case of change of supplier. The extension of this safeguard is not uniform in the various contracts and, in the case examined by the Court, the aspects of maintaining working time and contractual levels are deeply analyzed. The judgment also addresses the question whether a reduction in customer-determined supply is reasonable justification or not for the reduction in working time determined by the supplier: the negative answer saves the principle that working time is an essential element of the labor contract (which can not be altered by only one of its parts) but, at the same time, leads to the obligatory alternative of the termination of the labor contracts by the supply company subject to the reduction and  unable to provide other job opportunities to employees.
