Do judges make…life? Una cronaca della vicenda giudiziaria del caso Alder Hey Children’s NHS Foundation Trust c. Evans

Abstract

[Do judges make...life? A report of the case law Alder Hey Children's NHS Foundation Trust v. Evans] This article is a reconstruction of the judicial case of Alfie Evans. The work retraces the sentences that led to the interruption of the child's medical treatment. Particularly, the sentence of the High Court of Justice, adopted by Judge Hyden. The red thread of reconstruction is the principle of the best child's interest: using this standard the judge risks excessively appreciating a medical perspective, without taking into account all the constitutional interests of the case.
