Abstract
Il saggio analizza alcuni aspetti della nuova disciplina italiana della salute e sicurezza dei lavoratori entrata in vigore con il d.lgs. 9 aprile 2008, n. 81, modificato dal d.lgs. 3 agosto 2009, n. 106, cercando di evidenziare novità e conferme rispetto alla precedente disciplina contenuta nel d.lgs. 19 settembre 1994, n. 626. In particolare si sofferma l’attenzione sull’importanza della dimensione organizzativa della prevenzione che costituisce forse la maggiore innovazione apportata dal legislatore.
The paper examines some aspects of the new Italian laws regarding health and safety of workers coming into force of the Legislative Decree April 9, 2008, no. 81, as amended by Legislative Decree August 3, 2009, no. 106, seeking to highlight news and confirmations from the previous regulations contained in Legislative Decree September 19, 1994, no. 626. In particular, the paper focuses attention on the importance of the organizational dimension of prevention which is perhaps the greatest innovation introduced by the legislature.
