Abstract
Richiamando i precedenti saggi in materia dello stesso autore, il saggio analizza le novità normative nella gestione dell’emergenza coronavirus introdotte dal decreto del Presidente del Consiglio dei Ministri del 22 marzo 2020 e soprattutto dal decreto legge del 25 marzo 2020, n. 19. Il saggio si sofferma in particolare sul nuovo sistema sanzionatorio introdotto dal decreto n. 19/2020 il quale conferma come il sistema di gestione dell’emergenza sia completamente riconducibile ad una logica di tutela della salute pubblica. Inoltre, il saggio si sofferma sulla distinzione tra il sistema di gestione dell’emergenza del coronavirus e il tradizionale sistema di prevenzione aziendale sottolineando come il primo risponda al principio di precauzione, mentre il secondo attenga al principio di prevenzione. Infine si svolgono alcune considerazioni sulle possibili prospettive future ove sia necessario convivere per qualche tempo con la presenza del virus.
Referring to the previous essays by the same author, the essay analyzes the regulatory changes in the management of the coronavirus emergency introduced by the Prime Minister's decree of 22 March 2020 and, above all, by the decree law of 25 March 2020, n. 19. The essay focuses in particular on the new sanctioning system introduced by decree no. 19/2020 which confirms that the emergency management system is completely attributable to a logic of protection of public health. In addition, the essay focuses on the distinction between the coronavirus emergency management system and the traditional system of health and safety at work, emphasizing how the former responds to the precautionary principle, while the latter adheres to the prevention principle.
